Online music sales falter

So far, only 17% of online adults say they've cut back on file-sharing due to fear of legal consequences, says a Jupiter Research survey.

And because of piracy, competition for entertainment dollars, changing demographics, the end of the CD upgrade cycle, online music sales won't be as fat as it predicted at the beginning of the year, says the company.

In January, it forecast that US retail spending online would almost double from $2.6 billion to $5 billion by Christmas.

But now, "Due to overall music industry doldrums and lackluster digital offerings," online music will grow from less than $1 billion in 2003, to $3.3 billion in 2008, "when the Internet will account for 26% of U.S. music spending," it says.

At $750 million, online CD sales will remain essentially flat in 2003 and although Apple has rekindled interest in digital downloads, revenue from downloads and subscriptions won't be more than $80 million this year, states senior analyst Lee Black.

Nor is the picture much better in Europe.

"Europe's online music market has been stuck in the starting blocks for the last few years, but the tide is finally beginning to turn," said Jupiter. "EMI's decision to make most of its catalog available online is an eye-opener, and while consumer demand remains low and file sharing rampant, the foundation is now falling into place for Europe's legitimate online music market."

These numbers look dodgy. 2.5 to 5 billion of TOTAL online sales? Don't tell me they forecasted selling 5 billion in music online, that's just shoddy number crunching.

I think there's 5 billion in TOTAL ONLINE RETAIL this year, with their 750 million therein.

I love how they can see their sales at 750 million for this year alone in online venues and consider that a failure.

The real number to target is that 80 million in downloads/subscriptions. We need to get that to 0.00 Then they will be SCREAMING for another option.

Recording Industry Association of America

Cary Sherman is the president of the Recording Industry Association of America (RIAA). The trade group's more than 350 member companies are responsible for creating, manufacturing, or distributing 90 percent of all legitimate sound recordings sold in the United States.

As the president, Mr. Sherman represents the interests of the $14 billion U.S. sound recording industry -- the largest market for prerecorded music in the world. He coordinates the industry's legal, policy and business objectives and his responsibilities include technology, licensing, enforcement, and government affairs issues, among others. He also serves as the General Counsel of the organization. National Journal has described Mr. Sherman as an "intellectual property guru" and "one of the top copyright attorneys in the country."

Before joining the RIAA in 1997, Mr. Sherman was a senior partner at the Washington, D.C. firm of Arnold & Porter, where he was the head of the firm’s Intellectual Property and Technology Practice Group. One of his special areas of expertise during his 26 years at Arnold & Porter was reconciling developing technologies and intellectual property laws.

Mr. Sherman graduated from Cornell University in 1968, and Harvard Law School in 1971. An accomplished musician and songwriter, Mr. Sherman is an officer of the board of the Levine School of Music in Washington, D.C. He also serves on the boards of the Copyright Society and BNA’s Patent, Trademark and Copyright Journal, and has served on numerous other boards, including the Washington Area Lawyers for the Arts, The Computer Law Association, and The Computer Lawyer. He is also co-author of a two-volume treatise published by BNA Books, Computer Software Protection Law.

could it be oppressive DRM, use of the downloaded files, shitty formats (WMA), etc. as the cause?

Nope, gotta be the evil filesharers.

Try this: high bitrate MP3s, no DRM, no limitations on how many times I burn the file or transfer the file to portable devices. It can't be any worse than what they have going now (CD to MP3 to p2p service)

So if there used 100,000,000 sharing files in the United States, that means that there is only 83,000,000 remaining! Oh god! All it's going to take is another 5 massive publicity stunts and soon we'll all be "cutting back" on file sharing. Until those who have "cut back" realize that 871 supoenas equates to 0.00000871% of 100 million file sharers.

So to get everybody, the Industry would have to increase their number, and cost, of lawsuits by 11,481,000%.

Yes, that's right. If you want to know the chances of getting nailed, consider this: In order to nail *everyone*, their legal fees would have to increase by 11.5 million percent.

However, look at how much they are losing now. Once again citing my very favorite example of four students being sued for 94 billon dollars:

That's 23 billion dollars per person. For good measure, let's assume that the 100,000,000 file sharers have only 1/2 of that amount.. actually just make it one fourth.

That leaves each sharer liable for 5.75 billion dollars.

According the numbers, and according the RIAA any numbers that favor them can't lie, they are losing upwards of $575,000,000,000,000,000!

There you have it. That is their losses according to the reason of their application of U.S. copyright law.

want a great image of what is going to happen to the graphs of their music sales in August?
Remember that commercial for LifeAlert where the older lady falls and says:

Perfect description of their sales in August, September, October...they are falling and they can't get up!

Well, could someone please give me the list of non member labels? What is it, 4 of them? I am shocked to see that list. I thought most indie labels steered clear of the RIAA!!!!
