Dr. Dre To Pay $1.5 Million For Copyright Infringement

Tuesday was not Dre's day, as the G-funk doctor was ordered to pay more than $1.5 million to the copyright holder of a song he illegally borrowed a portion of for his last album.

A Los Angeles jury awarded London-based Minder Music Ltd. less than half of the $3.5 million originally sought after hearing testimony from the music publisher as well as Dr. Dre.

U.S. District Judge Consuelo B. Marshall, however, has not yet signed the judgment.

Howard King, Dre's lawyer, believes the case will be thrown out because of inconsistencies within the jury's findings.

Dre testified that before hiring a musician to play a bassline from the Fatback Band's 1980 song "Backstrokin'" for his 2001 track "Let's Get High," he consulted a musicologist who said the riff was commonplace.

The jury agreed, calling the rapper's actions innocent infringement, but fined him anyway.

i dont have $1.5 million dollars, and anyways, isnt this a man who didnt like us copying HIS songs? Shrug

yeah so he lost, but for dre aint that like me giving a guy 20$? 1.5 aint shit for that man...

Remember, this is the guy that joined Metallica on the whole "shut down Napster" thing... Seems only fitting to me that he gets fined for "stealing" someone else's music...

This whole thing brings up one point which isn't talked about much, sampling. Should samples be copyrighted, or should they be in public domain forever?

Damn, I just hope there isn't another lawsuit slapped for a beat that he'll lace Rakim up with for his future release. And this is just a big warning sign for Dre to make sure that he clears all the samples for his Detox album or else he'll be even more screwed Rolling On Floor Laughing!

"innocent infringement"?!? what is that? Its okay as long as you pay the original creator? That sounds okay to me (I havent heard both songs yet so Im talking legal theory here...) But then what should the penalty for file sharing be? 10¢ per song sent to the artist? (plus court costs of course)

But what sucks about all of this is that Dre was probabely a fan who was influenced by the music.If someone used my music I would be honor not pissed.

Yeah, I remember back when I had an account at that other music place that doesn't exist anymore, I tried uploading a remix, noting that I used voice samples from the movie Legend, and a musical sample from a song off the Brainscan soundtrack/score. They wouldn't let me showcase it because of the samples from Legend, but they never mentioned the sample from the Brainscan score.

So while I wouldn't necessarily suggest that you do it, if you're gonna sample chunks of songs, you might actually be safer going with something really vague.

Of course, this is the internet, so there's always a chance that your song will make its way to the ears of the original artist.
