I didn't catch American Idols tonight... but I was right, Nikki did get cut I found that out with quite a bit of displeasure here. She was so damn sexy too, oh well I'm sure she'll get somewhere in life. I see her in a movie or two in the future.

The assets of the long-shuttered Napster file-swapping service are expected to wind up in the hands of benefactor Bertelsmann Thursday, as the near-defunct start-up's bankruptcy hearings close.
Napster agreed to sell itself to Bertelsmann for just $9 million, barring the appearance of any other bidders in a bankruptcy court auction. Despite an attempt by Napster's creditors to raise interest in a competing bid, no rivals to Bertelsmann emerged.
The German media giant had already extended Napster close to $85 million in loans and contended that any rival bidders would have to take on that liability to exceed its bid.
It's not clear what role, if any, Napster will have inside Bertelsmann, however. The company had been the darling of former Bertelsmann Chief Executive Thomas Middlelhoff, who left the company in late July.
The new management, drawn from Bertelsmann's more traditional businesses, has not indicated what its plans for the once-popular file-swapping service might be.
Although it never officially launched, Napster developed technology for a file-trading service that would let people trade songs authorized by record labels for online distribution. Originally the service was designed to compete with Pressplay and MusicNet, the subscription services owned by the major music labels, but the labels never gave Napster the green light to launch. Poor Napster... well at least being a martr served a greater good with programs like Morpheus, Kazaa, and WinMX. I don't know why Bertelsmann would want it though.
Apple fights iDVD patch

WASHINGTON--Apple Computer has invoked the Digital Millennium Copyright Act to prevent its customers from burning DVDs on external drives.
Earlier this month, the company's lawyers sent a stiff warning to an Apple dealer, warning that a patch to Apple's iDVD burning software ran afoul of the controversial 1998 copyright law.
"They alleged it violated Apple's intellectual property and the DMCA act," said Larry O'Connor, president of Other World Computing, a Macintosh dealer.
O'Connor said his company values its close relationship with Apple--it's been a dealer since 1988--and backed down immediately. "No. 1, we don't want to get into a fight with Apple," O'Connor said Wednesday. "No. 2, we're an Apple certified developer. We're not out there to offend Apple."
At issue in the legal threat is Apple's well-received iDVD application, which permits users to burn DVDs only on internal drives manufactured by Apple. In unmodified form, it does not permit writing to external drives manufactured by third parties.
That means Macintosh owners with older computers or laptop computers, or people who opted not to buy the "Superdrive"-equipped Macs, could not use iDVD to save movies.
In response, Other World Computing began bundling a product called DVD Enabler with its external Mercury Pro DVD-R/RW FireWire drive. DVD Enabler modified iDVD so the application would save completed DVDs to a FireWire-connected drive.
A press release from Other World Computing dated Aug. 12 said the company "will no longer market its DVD Enabler software, effective immediately."
The DMCA, which took effect two years ago, limits selling software that "is primarily designed or produced for the purpose of circumventing protection afforded by a technological measure that effectively protects a right of a copyright owner."
Matt Deatherage, a former Apple employee who edits a daily Macintosh newsletter, said Apple's legal threat reflects the company's underlying business strategy: If iDVD is useful only on internal drives, people may buy more computers.
"I think it's one of those areas where Apple has decided it's an advantage to have iDVD on new machines and they don't want it available as an upgrade kit," Deatherage said. "Apple's basic job is to sell new machines. Hardware is 85 percent to 90 percent of Apple's revenue each quarter."
Other World Computing's O'Connor said he believes Apple made a bad decision. But, he said, "there was no ill will. We thought we were doing something good and hoped they would agree."
Apple does sell an iDVD upgrade on its site for $20, but it lists as a requirement a Macintosh equipped with an internal DVD-RW drive.
Apple did not immediately respond to a request for comment. Wow... That's cool... but were they able to just burn full movies or entire DVDS with menus intact? Either way I figure it's pretty damn cool. Let us fight the future and take down this Act.

After a few weeks of being unseated by new releases, and because it just felt so empty without him, Eminem will settle in atop the Billboard 200 albums chart again next week.
Neck-in-neck with him — as has been the trend since they both appeared on the chart together — is Nelly, who takes second place. The Eminem Show sold more than 170,000 copies, while Nellyville came in close behind with over 160,000 units moved, according to SoundScan figures released Wednesday (August 28). HA, keep looking RIAA number one MOST PIRATED ALBUM two weeks before release. If pirating and downloading ruins artists sales why is The Eminem show killing everyone else? Tell me TELL ME YOU BASTARDS!!!!!!!!
It's because his music is more creative and the downloads HELPED his sales. Stupid wankers.

8-year-old Canadien Crack Dealer

CALGARY, Alberta (Reuters) - An 8-year-old Canadian boy has been placed in foster care after he was caught aiding a drug dealer by holding crack cocaine for sale, police said on Tuesday.
An undercover officer discovered the child when he tried to lure the dealer into selling him 3.5 grams (an eighth of an ounce) of cocaine in a well-known drug-trafficking area east of the downtown core in Calgary, Alberta, on Friday.
The boy was found holding nearly three grams of the drug. It did not appear he had been using crack, Sgt. Sean Doyle of the Calgary police drug unit said.
"We have nothing to say that he's been at it for any length of time, but he was clearly under the direction of this older trafficker," Doyle said. "We had uniforms come in and arrest both of them."
The child is too young to be charged under Canadian law, so police turned him over to Family Services. It is not clear whether his parents knew of his activities, although Doyle said authorities had "intervened" with the family.
"It's an unfortunate situation to have an 8-year-old involved in trafficking crack," he said. "This is not usual. My thoughts are that this person who was the trafficker knows full well that the police can't arrest this 8-year-old."

Good article, I especially liked the "how do you do" to the RIAA about Eminem. You make a very good point that is going to get ignored by the RIAA. What the hell good does freedom of speech do if no one is listening?

Sad end to the once great Napster. Kinda like how the guy who invented television died poor. Is there no justice in the world? heh
Apple just wants to be as proprietary as they can.
And thank you for the apropos commentary on the Eminem sales. Saves me the trouble of sounding off.

Yeah the Eminem fact makes alot of sense, something that the RIAA definately will probably ignore. A fact that I'm glad that you pointed out even though I think he's slightly over-rated, and as for Nelly his rhymes are gabbage (worst then garbage) so I can care less about even sampling his tracks on downloads
Poor Napster... I'll miss that place, used to chat quite often on there but now they're.... ooh wait they was been gone  . They're plan on paid subscription sucked ass when it was first hatched considering the conditions of the plan so it's pretty much gone with the wind almost a year ago. Long Live P2P and for the 700,098th time R.I.P. Napster
