Ars Technica is reporting that the countersuit filed against the RIAA by Tanya Andersen is set to proceed next year. She claims "abuse of the judicial process" and has accused them of violations of RICO, malicious prosecution, violation of the Computer Fraud and Abuse Act (CFAA), invasion of privacy, and libel and slander, among other things.
The RIAA's case against her for illegal file-sharing was dismissed in 2007 and she was awarded attorneys' fees. She filed a separate suit against them later that year. The case continues but Judge Anna Brown has cut down those claims until only one remains: abuse of legal process. Her lawyer, Lory Lybeck, says the new trial will be about scoring a "Goliath verdict with punitive damages" against the record labels.
