whether or not jammie thomas is a commie or not is beyond me, all i know is that filesharing rules this country
pun intended being or not of sound shape or jammie did not share those files of her own free will instead she lucradized her own shadow of doubt and made mainstream a religion

let jammie share files and let her be done with it

So is the RIAA finally realizing how stupid and pointless it is sue everyone???? Are the old geezers finally waking up and smelling the coffee???

The funny thing about juries is that they are more times than not so, so eager to convict. Most jurors feel that they are serving justice by convicting, they seldom understand the balance between punishment that truly fits the crime and the crime or harm itself.

Case in point, one can make a sound argument that Thomas' file sharing folder was exposed. However, based on what I have read, I could not with reasonable certainty state (and for this I think no one can really) that at any given time and while Thomas' file sharing folder was vulnerable, that anyone downloaded files from her shared folder. That was never proven. I think that is what the RIAA should have to prove in a court of law, atleast if they are seeking damages from this person or anyone for that matter.

I mean if no one actually downloaded anything off of Thomas' folder then the RIAA has not really suffered any damages and $80, 000.00 seems far excessive. It should be the RIAA's burden to prove this and not the other way around.

Jurors are lay people, they are not experts in the legal field. And a pep talk by a prosecuting attorney, plus the definition of what it means to be a trier of law vs a trier of fact by the Judge will not make a juror all that more informed in the legal proceedings ahead of them. Often times Jurors receive these "Braveheart" styled speeches that make them feel like they are paladins of some sort of champions of justice. Little do they realize that behind all the flattering words, they are all just stringed puppets for both sides.
