The Australian recording industry has spent much of 2005 fighting the proprietors of Kazaa. In doing so they have continually invoked the names of Delta Goodrem, Jet and Powderfinger, who are arguably the three most successful Australia recording artists in the world. (No I haven’t forgotten Kylie Minogue – but she never wanted to sue the purveyors of P2P technology, so she is not part of this case).
Using names like Australia’s heroine Delta (she recovered from a bout of cancer) is attempts to not only win the legal war, but to win the PR war also. The article suggests that ARIA’s attempts are misguided, and the only winners in this case will be the lawyers, and that ARIA much like the similarly named RIAA is crying wolf when it comes to internet piracy. This article was published in Canberra’s leading newspaper (Canberra is the capital of Australia).

The really funny thing is that aside from one of their officers - Morle, who illustrated that he had virtually no idea how Kazaa was run - Hemming and Bermeister never gave evidence and rarely showed up in Court. Funny, Delta was not on trial but they certainly were.

Good on you k-gate, these people wont have it any way but their own. It was kazaa on trial not the artists they are cheating!
Wonder if they just want to whine about something or are they really serious about the debate.

Hemming and Bermeister were in court more often than the ARIA CEO or the ARIA Board. You don't suppose the ARIA people are trying to distance themselves from the case in case the pirate hunters get shot down in flames, as they surely will? And what were the IFPI people doing in court ... the invisible hand strikes again!

Hemming and Bermiester were the ones being prosecuted so they had a reason to be in court, which I might add didn't turn into a chance for either of them to get into the witness box and answer for the revolution. Niether could take those three short steps to the witness box....I wonder why?

Most legal counselors don't recommend taking the witness stand unless absolutely necessary.
