Website sued for giving a negative movie review.
Posted by DMemberDaniel in on September 16, 2004 at 12:27 PM

http://www.somethingawful.com/

Enter Something Awful, a website that searches out for Awful movies, Awful video games, Awful Porn, and especially Awful websites. S.A. reveals these websites and reviews them into oblivion for humorous purposes.

Every now and then, the SA crew searches for a bad game or movie, but then is totally suprised and gives a positive review (but still points out problems and blows them out of proportion for your amusement.)

This review, for the 1997 plop "Pocket Ninjas" is not such a case.

Something Awful has revieved threats of a lawsuit for posting this review. So it seems that the lawyers demand censorship.

But Something Awful has recieved lawsuits before, and they fearlessly "review" the lawsuit for your enjoyment. Take a look.

Wow, so much for freedom of speech. You can no longer critique a movie?

this is strange because there's a saying that there's no such thing as bad publicity.

judging by the mispelled words in the article, the site could be making all this up for free publicity.

Free speech is one thing, but there is still this thing know as slander that people do get sued for regularly...I suppose telling people you didn't enjoy the movie because of this or that, is a trifle different than saying it's a bad movie because of such and such----only a lawyer can tell what that difference would be I guess, because I sure wouldn't know.

"...wait till they review a big budget film... watch MPAA 'crack down'"

Heaven forbid that anyone with a divergent opinion stand in the way of the maximum money or the pervasive power that these greedy industries crave!

When someone writes you and tells you what their counsel wants you to do, it makes you wonder why their mouthpiece can't speak for themselves.

When someone is threatening you legally, and they really HAVE an attorney, you get a letter from the attorney on law firm letterhead, demanding you do something, and citing legal reasons WHY...this threat, was one of the most pathetic I've seen. And, since Network Solutions is not a party to any threatened legal actions, why were they carbon copied.

That was pathetic!

By that way...ya gotta read their detailed answer to that letter.

It was a rebuttal truly worthy of framing, and though, I have never seen nor ever intend to see anything as stupid as a movie named "Pocket Ninjas"... I am certain that the rebuttal was far more entertaining than that movie!

"No material from this site can be downloaded or copied or altered without expressed written permission." is emblazoned on the spash screen....

But, just to see that splash screen, your computer downloaded all the graphics and text on THAT screen, along with their silly logo, without their permission, so you are already in violation.....

"It AM crazy world".

FYI, here is a lawyer's definition of a direct threat:

"A direct threat against Dave Eddy: "And so help me God, if I ever see another montage again, something terrible is going to happen. My fondest desire is to find myself in a situation where I can actually pick up screenwriter Mark Williams and use him as a projectile weapon with which to bludgeon Dave Eddy into a coma.""

After going to their website and seeing the movies they are making. (Vampire Assassin-"blade" and Internetrix-"Matrix") somone should sue them for making crappy movies that have already been made.

No wonder the Canadians call Americans idiots. Because the americans cannot speak for themselves. They always got to get their damn lawyers to speak for them.

Which one is worse? The fact that they'll pay $2000 in court fees or the lawyer laughing them out of court they still pay the $2000 court fees?

There's a thing called grammer... I seem to forget it sometimes...

I've noticed some real neat forums which allow previews before posting...really handy.

Holy Crap their "Legal" section is funny!

Kinda like that guy in Sweden who told the lawyers threatening him with the DMCA to f-off.

I love it when people aren't intimidated by that "I'm gonna sue you" threat.

heh, SomethingAwful is nice. I started to love them! :) (Smile)

However, they haven't been threatened for posting the negative *MOVIE* review, but rather, for the personal attacks on its makers (directors, producer, or how is he being called). Of course, I think that the threat is empty and bogus and American First Amendment to the US Constitution protects such form of speech, too. And even if it wasn't legally bogus, I would oppose the film maker's action as anti-freedom and plainly stupid -- for all he achieves will be to get even more mocking.

Besides, in Poland there would be probably a criminal trial, not even for slander or libel, but just for INSULT (it's a "crime" in Poland, too). That's why I think USA is a free country (despite some tyrannic elements as RIAAitism, War on Drugs, etc), while Poland is NOT.

You can't even express an opinion without getting slapped with a lawsuit now? Wow...

"If only I could sell the bile that rises in my throat every time I see this scene..."

Great review.

haha.. i was reading that.. my favorite excerpt so far

"We cut to a parade somewhere, where the Dragons lead the Stingers on a chase through the crowds of people and down a few city blocks. The chase ends suddenly with no resolution and no explanation of why either gang was there in the first place. The scene is never mentioned again. I repeat, the filmmakers wasted untold amounts of time and money to organize an outdoor, on-location film shoot during a parade (I'm making the correct assumption that they didn't arrange the parade themselves), meaning they were on a strict timeframe and were counting on huge numbers of people, just so they could shoot a scene that is completely and utterly pointless. Wow."
