Solution? Encrypt your damn E-Mail. The more companies/organizations try to spy on us, the more people are going to find a way to keep their stuff private. Eventually you WILL need every piece of data you send out encrypted, which is the true travesty of this whole mess, but whatever is required to keep your stuff private...

This right to read your e-mail isn't a right. Some judge thinking it is ok, don't make it right either.
It seems more and more there is no privacy on line. Between everyone and their bother wanting valid e-mail addresses to sell at 600 bucks per 10,000 to spammers; to ad companies wanting to know where you go and what you do on line to tailor their ads towards that. I resent the whole passel of stuff going on that smacks of this, "It's just on line stuff so it is ok."
Heck no it isn't ok and I for one resent it. If my info is so valuable, then where is the money in my hand to show that? Simply it isn't there. It is ok to read my private e-mail, ok to see where I go, ok to load and slow my computer down (provided I don't clean it regulary) and ok to steal my bandwidth that I pay for to do this without asking permission.
Even the RIAA itself has had its paw slapped by micro$uck$ for not paying for the software on a "per seat" basis. Seems they think it ok to "steal copywite infringement" as long as it benefits them. But you can not have it both ways. (As they found out when they had to pay up.) Funny that they should be caught within the very trap they laid out for others. What delicious irony there was to that.

Yep there is no privacy.
Private key encryption is the only real safeguard, and let's face it, if they target you specifically, they CAN and WILL break any encryption you load up on things. Our real protection is in our numbers. We are legion and we each have dozens of emails out there. There is no way for them to randomly stumble over our things, in any real repeatable way. They have to be looking for things or people specificially.
GMail and the new Hotmail will come with henious TOA that specifically empower them to scan your mail and market to you based on what they find. Anyone know whats in the new YHOO TOA?

A theory:
Everything you write...even a simple note...is automatically considered copyrighted according to US law. All you have to do is encrypt it, even with the simplest and easiest to crack encryption. Then, anyone who cracks your encryption (i.e. e-mail server host, ISP, etc.) in order to read/scan your e-mail has violated the DMCA and you can sue them. Use the MPAA/RIAA's precious law against them. See how they like it. Remember, under the DMCA, it doesn't matter if their intended use of the information is legal, they are still breaking the law the moment they circumvent your encryption.
