Wiretaps for Civil Copyright Infringement?
Posted by AdminCodeWarrior in on March 29, 2004 at 5:49 PM

"Under 18 USC 2516(3), you can get a wiretap for any "electronic communication" (but not for wire or oral communications) as long as "the interception may provide or has provided evidence of any Federal felony." Copyright infringement under 17 USC 506 is a felony. Under the proposed PIRATE Act, the government has options with regard to people who violation 17 USC 506 (Criminal copyright infringement). The government can criminally prosecute them or bring a civil suit. Either way, the government can use a wiretap to gather evidence for their case.

Under a regular civil suit for copyright infringement by means of file sharing, the copyright holder can only observe that the infringing files are available for download. They can't really tell how many people have downloaded them, if any. Furthermore, copyright holders have no way of going after people who are only downloading files and not uploading them. Wiretaps to the rescue. The RIAA may not be permitted to wiretap file sharers, but the government certainly can. The RIAA must be salivating at the prospect."

They can't catch everybody, first of all. Secondly, I only download non-RIAA music. It's actually very easy to download non-RIAA music when you're into the underground scene and punk music. No, not that poppy crap on the radio. That's not punk. That's not music. That's a joke. If they were to try and sue me for copyright infringment, the band will most likely hear of it and shit bricks. Don't believe "conservativepunk dot com", there's no such thing as a conservative punk and odds are, the band will try and drop the suit to spite the gov. That's the truth of it. Oh yeah, and AT www.alternativetentacles.com has tons of MP3s for download. All off of their label. Wiretaps? You people are so full of yourselves. What are you going to do with a third of the population in prison? How about one sixth. One tenth. One hundredth. And you wonder why the economy is in the toilet? Will they still purchase your CDs from prison? Will they still pledge to your flag? Where will you put all of these people? Will you be able to feed all of these people? I hope you realize this before it all happens.

lol.

"We got him! They are going to rendezvous in Bobby's bedroom, after supper-time."

*Bobby starts to hand friend CD*
*SWAT team flies through the windows and splatters their pirate blood everywhere*
*SWAT team vanishes without a trace.. like ninjas*
*Bobby's mom regrets buying burner*

I don't care if they wiretap me. I'd have no problem with saying "Ok, and I'll have your 10 burned CD's with me too" during every single phone conversation. Just wastes their resources.

or..."My mom calls those new paper towels..weapons of mess destruction"

"Condoleeza promised me she would not tell them those 911 secrets"...

Hey, I have a question, since it's sorta in discussion. I've been wanting to get into the ungerground scene of music. I'm really tired of RIAA music, and find myself listening to less and less of it (there are still a few bands I listen, but I don't buy CDs or anything). Anyway, any of you guys have good suggestions. I'm not really into punk music, I like alternative and rock more.

Thanks

uhh.. the moment i hear about government wiretaps on my computer i will start making my plans to move to canada.

I will be voting by feet since voting by ballot no longer matters, and is more like picking your poison.

So the solution is to get nasty. Start sharing files containing random data with names like "Britney Spears - One More time - [fake].mp3" or "Spice Girls [F*A*K*E] - 2 become 1.mp3". That is, create files with random data (dd if=/dev/urandom of=filename.mp3 works) and name them after popular RIAA music, but be sure to label the fake files so a human (but probably not a computer program) can tell they are fake.

Freedom-Will-Come: Hey, I don't know too many underground rock bands, but here are a few... Lard, Thrall, Lords of Acid (they are industrial), Leftover Crack (they are hardcore), Agony Scene (they are also hardcore), Genitorturers (industrial... not too sure if they are RIAA owned but they aren't on the radio), GG Allin (he has so many different bands that it depends on which one you pick.), Victim's Family (not really hard rock). I don't know too many others...
